These Terms of Service ("Terms") are a legal agreement between you and Solano Software LLC ("PlayDay," "we," "us," or "our") governing your use of the PlayDay mobile app and web dashboard (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of a childcare business, you're agreeing on its behalf and confirming you have the authority to do so.
Please also review our Privacy Policy, which explains how we collect and use information and is incorporated into these Terms by reference.
You must be at least 18 years old and able to form a binding contract to create an account. The Service is not directed at, and may not be used by, children. Providers must be lawfully operating (or in the process of becoming licensed as) a childcare business in their jurisdiction. Parent/guardian accounts are created by accepting an invitation from a provider or by completing that provider's intake form.
You're responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away at support@playdaycare.app if you suspect unauthorized use.
PlayDay helps childcare providers record daily activity logs (meals, naps, diapers, milestones, attendance), message with families, track immunization and enrollment records, generate childcare-licensing paperwork, and manage tuition invoicing — and helps parents stay connected to their child's day and view invoices. We may add, change, or remove features at any time, and we may suspend the Service for maintenance or other operational reasons.
You're responsible for the accuracy of information you submit about your child, including through an intake form, and for keeping emergency and medical information current with your provider. Your access to logs, messages, and invoices is tied to your relationship with the provider who invited you; if that relationship ends, your access may end too.
AI-assisted features are assistive, not authoritative. The Service uses a third-party AI model (Google's Gemini API) to save you manual data entry in several places: reading an uploaded vaccination record to suggest dose dates, reading a scanned intake document to prefill a new child's record, parsing a Quick Note into structured daily-log entries, and proposing how the fields on an uploaded licensing PDF template map to the Service's data schema. Each of these is provided "as is," may contain errors or omissions, and must be reviewed and confirmed by you before being relied on for licensing compliance, a child's record, or any other purpose. We are not liable for decisions made based on unverified AI-extracted or AI-parsed data.
The Service lets providers create tuition invoices and record payments (e.g., cash, check, Zelle, Venmo) so families can track balances. PlayDay is a record-keeping tool only — we do not process, hold, or transfer any tuition payment. Payment happens directly between the provider and family, outside the Service, using whatever method they agree on. We're not a party to that payment relationship and aren't responsible for disputes about it.
You retain ownership of the photos, videos, messages, notes, and other content you submit to the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and transmit Your Content solely as needed to provide and improve the Service. You represent that you have the rights necessary to submit Your Content, including any consents needed to share photos or information about a child with the other party (provider or parent) in the relationship.
You're responsible for Your Content. We may remove content that violates these Terms or applicable law.

The Service, including its software, design, and branding, is owned by Solano Software LLC and protected by intellectual property laws. These Terms don't grant you any right to our trademarks or branding, and we grant you only a limited, revocable, non-transferable license to use the Service for its intended purpose.
The Service relies on third-party providers — including Google Firebase, Resend, Expo, RevenueCat, Apple, Google Play, and Google's Generative AI API — to operate. Your use of the Service is also subject to those providers' own terms where applicable (e.g., app store terms for in-app purchases). We're not responsible for the availability or performance of third-party services outside our control.
You may stop using the Service and request deletion of your account at any time — see the Delete Your Account page. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service, with notice where reasonably possible. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) will survive.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated suggestions or generated forms will be accurate or sufficient for licensing or legal compliance purposes. The Service is not a substitute for professional medical, legal, or regulatory advice.
To the maximum extent permitted by law, Solano Software LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100. Some jurisdictions don't allow these limitations, so some of them may not apply to you.
You agree to indemnify and hold Solano Software LLC harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
